If so, the Nebraska Department of Economic Development (Department) has a position that may be right for you. The Department is seeking to fill an Attorney III position on its Compliance Team. This attorney supports the compliance efforts of the Department as part of its compliance team. Under the direction of the Director of Compliance, the attorney will provide legal services to support the internal auditing and external monitoring efforts of the state and federally funded programs administered by the Department.

Examples of Work
Research and interpret statutes and regulations applicable to the various state and federal programs administered by the Department. Draft or review legal documents such as contracts, amendments, agreements, guidance documents, etc.

Provide legal opinions to Department and division management related to program administration particularly as applicable to the Department's compliance efforts. Assist in the development of policies and procedures, risk assessments, auditing, and monitoring for various Department programs. Maintain current knowledge of relevant statutory and regulatory requirements.

Assist in responding to audits of the Department by state or federal entities. Represent the Department at audit, management, or other meetings as assigned. Assisting in the review of pending legislation to determine its effect on operations and administration of the Department programs or function impacted.

Recommend procedural changes necessary to comply with statutes and regulations. Performing other duties as assigned within the scope of the classification. Other duties as assigned.
Qualifications / Requirements
REQUIREMENTS: Three years of experience as an attorney practicing law and providing legal services such as preparing and trying cases, advising clients, and/or interpreting laws or administrative policies.

PREFERRED: Five years of experience working with state and/or federal statutes and regulations, particularly those relevant to grant administration.

OTHER: The applicant must attach a law practice related writing sample.

LEGAL REQUIREMENTS: In accordance with Section 7-101, Nebraska Revised, Reissued Statutes of l943, incumbents in this class must be admitted to the Nebraska Bar.

SPECIAL NOTE: Candidates who have obtained a Juris Doctor degree but are not licensed to practice law in Nebraska may be considered for provisional employment for up to six months. Any such provisional employment must occur within or coincide with a probationary period in accordance with Title 273, Nebraska Administrative Code, Chapter 6. Licensure to practice law in the state of Nebraska must be obtained within the probationary period for continued employment. Such candidates may not perform those job duties that require a license to practice law until such proper licensure is obtained.

State agencies are responsible to evaluate each of their positions to determine their individual overtime eligibility status as required by the Fair Labor Standards Act (FLSA).
Knowledge, Skills and Abilities
Knowledge of: The techniques of preparing and drafting of legal documents and forms; judicial procedures and rules of evidence; the principles and practices of legal research; the procedures of trial and administrative hearings;

Skills in: Preparing summaries, legal analyses, findings and conclusions, briefs and other legal documents; negotiating and communicating with others sufficient to persuade their acceptance of differing goals or viewpoints; analyzing and interpreting various factors, perspectives, and options and applying critical thinking to resolve issues.

Ability to: Prepare and communicate in person and in writing to persuade others to accept the viewpoint presented;work collaboratively as part of a team; interact respectfully with other attorneys, staff members, other governmental employees, the public, and representatives of Department customers; formulate legal opinions and recommendations based on legal research and investigations; conduct legal research and investigations; identify critical elements of legal questions or issues; prepare/draft legal documents and forms; interpret and apply statutes, regulations, case law, decisions of courts and administrative tribunals, and administrative rules and policies.
